CANCELLATION POLICY
I hereby affirm that I am aware of the cancellation policy set by Volleyball Vacations (VBV) and Beach Agency Group (BAG).
* Bookings are nonrefundable within 120 days of event start date.
* Bookings are transferable and name changes are allowed only if available based on Club Meds availability at time of change request. Guest will be required to pay fee if applicable by Club Med.
* There is a $200 administrative cancellation fee unless guest is able to provide a substitute "new guest" in their spot via name transfer at time of cancellation request. Guest is responsible for any additional Club Med name transfer fee if any.
* Pro coaches are subject to change and this is not a reasonable excuse for a trip refund.
* Payments due in full August 2, 2023.
* In case of event cancellation due to inclement weather or force majeure (i.e. hurricane damage to resort, Pandemic) guest will receive a voucher from VBV to join a future VBV without any additional fee replacing the same room category that was originally booked. No refund will be awarded and future volleyball vacations event voucher will be valid for up to 3 years.
ACKNOWLEDGMENT, WAIVER AND RELEASE
I hereby affirm that I am aware that all sports participation has inherent risks, which may result in serious injury, death, or property damage.
I understand and agree that neither my instructor(s), facility through which I participate, nor the owners or operators of said facility, nor the VBV, BAG, nor their affiliates and subsidiary corporations, nor any of their respective employees, officers, volunteers, staff, agents, contractors, sponsors, suppliers, or assigns (hereinafter collectively referred to as “Released Parties”) may be held liable or responsible in any way for any injury, death or other damages to me, my family, estate, heirs or assigns that may occur as a result of my participation in this program or any competition or as a result of the negligence of any party, including the Released Parties, whether passive or active, including any failure to follow all applicable rules.
I hereby acknowledge that VBV pros are subject to change and pro coach cancellation will not be accepted as a reason for refund.
I hereby agree to be filmed, videotaped, photographed, or live broadcast and to have my image and voice otherwise recorded, in any media, during the program, including any competition, by any photographer(s), film crew(s), TV crew(s) and video crew(s) authorized by VBV, BAG or the owners or operators of the facility, or any of their affiliates or subsidiary corporations.
I hereby grant VBV, BAG, and the owners and operators of the facility, and their affiliates and subsidiary corporations the irrevocable, perpetual, fully paid-up, worldwide right and license to use, and to authorize third parties to use, in all media, my name, picture, likeness, voice, biographical information and or contest performances for: (1) news and information purposes, (2) promotion of specific competition(s) in which I compete, (3) promotion of the event in which I was participating or the promotion of beach volleyball, and (4) promotion of VBV, BAG, owners and operators of the facilities, and their affiliates and subsidiary corporations, or any of their programs; except in no event do I authorize the use of my name, picture, likeness, voice and biographical information for an endorsement of any other company, product, or service, without my written permission.
In consideration of being allowed to participate in instruction, training, and competition in all sports, hereinafter referred to as “program,” I hereby personally assume all risks of this program, whether foreseen or unforeseen, that may befall me while I am a participant in this program including, but not limited to, any academic or out of venue instruction, in venue activities, and fitness activities conducted at the facility.
I willingly agree to comply with the stated and customary terms and conditions for participation in the program. If injured I authorize first aid treatment by trainers and other personnel customary in all sports events and any medical treatment by a qualified and licensed physician in the event of a medical emergency which, in the opinion of the attending physician, may endanger my life, cause disfigurement, physical impairment or undue discomfort if delayed.
I, for myself, and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, hold harmless and promise not to sue the Released Parties with respect to any and all such injury and loss arising from my participation whether caused by negligence of the Released Parties or otherwise, except that which is the result of gross negligence or willful misconduct of the Released Parties, to the fullest extent permitted by law.
I also understand that beach volleyball is a physically strenuous activity and that I will be exerting myself during this program, and that if I am injured as a result of contact with an opponent’s blood, other bodily fluid, falling, heart attack, panic, hyperventilation, or any other cause, that I expressly assume the risk of said injuries and that I will not hold the Released Parties responsible for the same.
If Covid-19 safety protocols still exist at time of this event then these rules will be strictly enforced. You agree to follow Club Med and Turks and Caicos local regulations and requirements to ensure safety for all guests. If you disagree with these requirements at time of event and decide not to participate, Club Med and VBV have the right to cancel your involvement in the exclusive volleyball program and Club Med rules and regulations will apply.
I further state that I am of lawful age and legally competent to sign this liability release, or that I have acquired the written consent of my parent or guardian. I understand the terms herein are contractual and not a mere recital, and that I have signed this Agreement of my own free act and with the knowledge that I hereby agree to waive my legal rights. I further agree that if any provision of this Agreement is found to be unenforceable or invalid, that provision shall be severed from this Agreement. The remainder of this Agreement will then be construed as though the unenforceable provision had never been contained herein.
I understand and agree that I am not only giving up my right to sue the Released Parties but also any rights my heirs, assigns, or beneficiaries may have to sue the Released Parties resulting from my death. I further represent I have the authority to do so and that my heirs, assigns, or beneficiaries will be stopped from claiming otherwise because of my representations to the Released Parties.
BY THIS INSTRUMENT AND IN ACCORDANCE WITH ITS TERMS, I AGREE TO EXEMPT AND RELEASE MY INSTRUCTORS, THE FACILITY THROUGH WHICH I RECEIVE MY INSTRUCTION, THE OWNERS AND OPERATORS OF THE FACILITY, VBV, BAG, AND THEIR AFFILIATES AND SUBSIDIARY CORPORATIONS, AND ANY OF THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, VOLUNTEERS, AGENTS, MEMBERS, CONTRACTORS, SPONSORS, SUPPLIERS, OR ASSIGNS FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH HOWEVER CAUSED, INCLUDING BUT NOT LIMITED TO THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE, AND I AGREE TO ALL OTHER TERMS MORE FULLY SET FORTH IN THIS AGREEMENT. I ALSO AGREE TO BE FILMED AND TO HAVE MY IMAGE OR LIKENESS USED BY OTHERS AS PROVIDED IN THIS AGREEMENT. I ALSO AGREE TO THE PROVISION OF FIRST AID OR MEDICAL TREATMENT TO ME IF I AM INJURED AS MORE FULLY SET FORTH IN THIS AGREEMENT. I HAVE FULLY INFORMED MYSELF AND MY HEIRS OF THE CONTENTS OF THIS LIABILITY RELEASE AND ASSUMPTION OF RISK AGREEMENT AND LIKENESS RELEASE BY READING IT BEFORE I SIGNED IT ON BEHALF OF MYSELF AND MY HEIRS.
CLUB MED TERMS & CONDITIONS
Arrival and departure times: Check-in is at 3:00 P.M. Checks are not accepted for bookings which include certain types of airfare. Please inquire at time of booking. Your room may not be immediately available upon your arrival. Check-out time is 9:00 a.m. Members may request a late check-out time with extra cost at the resort, but it is not guaranteed. Note that your vacation package includes travel time in both directions: package prices are based upon the number of nights in your stay.
Final payment: final payment is due August 2, 2023. Failure to receive a final payment on time will subject the booking to cancellation and the imposition of cancellation charges.
Membership: annual membership fees are required and included in your package price.
Travel documents: proof of citizenship, passports, visas, tourist cards, health recommendations, inoculations (where required) and compliance with customs regulations are the responsibility of the member. Club Med sales, inc., shall not be responsible if boarding or entry is denied or delayed or if cancellation charges are imposed or additional costs incurred as a result of the failure to provide required travel documents. All information should be confirmed directly with the appropriate government consulate or tourist office in advance of departure. If a birth certificate is being used, please make sure it is an original or certified copy with raised seal, and bring an additional government issued picture I.D. (such as a driver’s license).
Alcoholic beverages: operators reserve the right to refuse the sale and/or service of alcoholic beverages in accordance with operators’ policies and the applicable legal age limitation of the country in which the resort is located. Operators reserve the right to limit or deny the member’s right to bring alcoholic beverages to the resorts for consumption on the resort premises.
Sport programs: members are not obligated to participate in activities or sports programs. Sports and other similar activities intrinsically involve risk of physical injury greater than that encountered in daily life. When a member participates in a sports program or similar activity and uses the operators’ facilities during the vacation, you do so at your own risk. You must exercise all necessary care and caution, having regard to the nature of the activity, the terrain, location, climate, co-participants and other circumstances. Member must ensure that he or she is physically fit to participate in such activities. Operators reserve the right to exclude members from participating in certain activities, if in the sole discretion of operator or its Medical personnel, such participation could present a risk to the member or others.
Liability: Club Med sales, inc., is the sales agent for Club Med vacations (the vacation). We do not own, manage, control or operate any transportation vehicle, hotel, Club Med resort, cruise ship, restaurant or other supplier of services. The Club Med portion of your vacation is provided by Club Med, inc., Club Med Amérique du Nord, SAS, Club Mediterranee S.A. or certain of their subsidiaries or affiliates. The names of the entities operating each of the various resorts are available upon request from the guest relations department (collectively, the operators). Other independent third parties provide transportation, transfers and accommodations, sightseeing excursions and certain other services (such as golf, deep-sea fishing, horseback riding, etc). Such parties are independent contractors and not employees or agents of Club Med sales, inc., or the operators. All arrangements with such independent contractors are made solely for your convenience and are at the member’s risk. Members Release Club Med sales, inc. And the operators from and against any claims for loss or damage to baggage or property, or for personal injuries or death, or for any loss from delay arising out of the acts, omissions or negligence of any independent contractors, such as air carriers, hotels, excursion providers, restaurateurs, transportation providers, or Medical personnel. Each member agrees to indemnify Club Med sales, inc., and the operators for all penalties, fines, charges, losses or expenses incurred by virtue of any act, omission or violation of law by the member. Each member, or if a minor, his or her parent or guardian, shall be liable to and shall reimburse the operator for all damage to the resort and its furnishings or equipment, caused by any willful or negligent act or omission on the part of the member. Neither Club Med sales, inc., the operators of the vacations nor their agents, servants, or employees, nor your travel agent assume responsibility for any claim, action, cause of action, injuries, losses or damages arising from the actions of third-party contractors supplying services on the vacation, including but not limited to, reservations, transportation, hotel, food, or sightseeing services, failure of aircraft or water craft, or any other means of transportation, missed connections, lost or stolen items, costs or expenses arising out of injury, gambling losses, accident or death, quarantine, disturbance, government restrictions or regulations, damage, loss or delay of baggage or other property, inconvenience, loss of enjoyment, loss of pay, disappointment, mechanical breakdown, government actions, strike, lockouts, war, terrorism, weather, acts of god, force majeure or other factors or causes beyond our control.
Personal property: under no circumstances may dangerous articles such as controlled substances, firearms, explosives, cylinders containing compressed air or combustible substances, be contained in any baggage or brought into any Club Med resort. The operators reserve the right to refuse to permit any member to bring on the vacation any item that the operators deem inappropriate. No animals are permitted (with the exception of service animals for members with special needs.) Please note that safekeeping facilities in many resorts may be limited. Members should limit the number of valuable items brought to the resorts. Property lost or stolen must be reported immediately to the reception desk or to a designated Club Med employee prior to leaving the customs area. The liability of Club Med sales, inc. And the operators for property lost, damaged or stolen shall be limited to $500 or in accordance with the local law of the resort, whichever is less.
Itinerary or program changes: the operators reserve the right to withdraw or modify resorts, tours, itineraries, programs, sports activities or facilities at anytime without notice and without liability. During local or national holidays, certain facilities such as museums, sightseeing tours or shopping may be limited. In the event of force majeure, including but not limited to strikes, lockouts, riots, weather conditions, technical difficulties or for any other reason whatsoever, Club Med
Sales, inc., and the operators may at anytime and without prior notice, cancel, advance, postpone or deviate from any vacation package and shall not be obliged for any loss whatsoever to any member by reason of such cancellation, advancement, postponement, deviation or substitution.
Refusal of travel: a member may be asked to leave a resort or deplane at any time without refund if (i) the member is unfit for travel (ii) a risk or danger to himself or herself or (iii) a disturbance or danger to others. In such event, the member shall not be entitled to any refund, and the member shall be responsible for all lodging, meals, return transportation or other expenses incurred.
Claims: you agree that (i) any claims relating to vacations are null and void unless made in writing and sent via certified mail, return receipt requested, to Club Med sales, inc., guest relations 7001 n. Scottsdale rd. Suite 1010,Scottsdale, AZ 85253 within 60 days of your vacation (ii) Legal proceedings are time barred if not brought within one (1) year after the commencement of your vacation; (iii) The laws of the countries where the resorts are located may govern the disposition of your claim and in some cases may limit your recovery and damages.
Photograph: Club Med sales, inc., and operators have the exclusive right to include photographic, video and other visual portrayals of member in any pictorial Medium of any nature whatsoever for the purpose of trade, advertising, sales, publicity or otherwise, without any further compensation therefore, and all rights, title and interest therein (including all worldwide copyrights therein) shall be Club Med sales, inc., and operator’s property.
Transfers: transfers between airports and resorts are on a group basis, either by coach, van or taxi (at the selection of the operators). Members who have arranged their own air transportation must transfer at their own expense.
Major changes: if we make a major change prior to departure, you have the right to cancel and receive a voucher to attend a future volleyball vacation event without any extra fee (same category room originally booked) but will not have the right to a refund. The following are major changes: (1) a change in the origin or the destination city in the vacation package, unless that change affects only the order in which cities in the tour packages are visited; (2) a substitute change results from a flight delay experienced by the air carrier (if delay is longer than 48 hours, it will be considered a major change. No compensation or refunds will be issued for flight delays of less than 48 hours); (3) a price increase of more than 10 percent occurring before departure. If a major change must be made in the program, we will notify you within 7 days after first learning of the change, but in any event at least 10 days prior to the scheduled departure. If less than 10 days before the scheduled departure we become aware that a major change must be made we will notify you as soon as possible. Within 7 days after receiving notification of a major change, but in no event later than departure, you may cancel your reservation and you will receive a full refund within 14 days after canceling. If a major change occurs after departure of the flight which you are unwilling to accept, we will refund, within 14 days after your scheduled return date, that portion of your payment which applies to the services not accepted. If we must cancel the charter we will notify you within 7 days of the cancellation, but in no event no later than 10 days before the scheduled departure date. We have no right to cancel the charter less than 10 days before departure, except for circumstances that make it physically impossible to perform the charter trip. If the charter is canceled, we will make a full refund to you within 14 days after cancellation.
The travel insurance contract provides in particular in the event of Illness (including COVID disease) as defined in the Information Note.
- Medical expenses abroad until 75 000 € incl. tax / beneciary,
- Advance on hospitalisation costs incurred abroad until €75,000 incl. tax per beneficiary,
- The cost of an extended stay at the hotel: € 80 per night incl. tax and € 150 incl. tax for a family / 10
nights maximum,
- Medical evacuation and repatriation following accident and/or illness according to the decision of the
Medical Board of Europ Assistance,
- Repatriation of the mortal remains in case of death.
